Terms & Conditions

1. Definitions
- "Cairnpost", "we", "us", "our" — the document coordination service operating from 10 Jalan Tengku Ampuan Zabedah, 40100 Shah Alam, Selangor, Malaysia.
- "Service" — the clerical document location, sorting and chronology coordination services offered by Cairnpost as described on this website and in written engagement scopes.
- "Client", "you", "your" — the individual or family who engages Cairnpost under a written scope agreement.
- "Session Output" — any printed sheet, index, chronology, bound pack or digital mirror produced by Cairnpost as the deliverable of an engagement.
- "Agreement" — the written scope document signed by both parties before a session or programme begins, together with these Terms & Conditions.
2. Acceptance of Terms
By signing a written scope agreement with Cairnpost, or by using this website to submit an enquiry, you confirm that you:
- Are at least 18 years of age
- Have the legal capacity to enter into an agreement
- Accept these Terms & Conditions in full
Use of this website without engaging a paid service does not create a contractual relationship beyond acceptance of the website terms set out here.
3. Description of Services
Cairnpost provides clerical document coordination services only. Our three current offerings are described on our Solutions page. All services:
- Are clerical in nature — sorting, locating, indexing and chronologising documents
- Do not constitute legal, financial, estate, tax or professional advice of any kind
- Do not involve valuation or interpretation of any document or asset
- Do not involve correspondence or representation on behalf of any client
Services are available to families located in Selangor and Kuala Lumpur. Geographic availability may change without notice.
4. Scope Agreement
No coordination work begins without a written scope agreement signed by both Cairnpost and the client. The scope agreement sets out the specific deliverables, the session dates, the fee, and the limitations of the engagement. These Terms & Conditions are incorporated into every scope agreement by reference.
5. Payment Terms
Fees are as stated on the Solutions page and confirmed in the written scope agreement. All fees are in Malaysian Ringgit (RM).
- Where Things Live Session (RM 445): Payment due in full before the session date.
- Archive Sorting Appointments (RM 1,220): 50% deposit required to book; balance due before the second appointment.
- Chronology and Handover Programme (RM 3,860): 30% deposit on agreement; remainder paid monthly across the three-month programme.
Accepted payment methods: online bank transfer or cheque payable to Cairnpost. Payment receipts are issued for all amounts received.
6. Cancellation and Rescheduling
- Sessions cancelled with more than 5 business days' notice: deposit refunded in full.
- Sessions cancelled with 2–5 business days' notice: 50% of deposit retained to cover coordinator time allocation.
- Sessions cancelled with less than 2 business days' notice or not attended: full deposit forfeited.
- Rescheduling with more than 2 business days' notice: accommodated without charge, subject to availability.
7. Client Responsibilities
Clients agree to:
- Provide a safe and accessible location for the coordinator to work
- Make documents available at the agreed time and place
- Ensure that any family member present during a session has authority to allow documents to be handled
- Not request that Cairnpost provide legal, financial or estate advice
- Not misrepresent the purpose or content of a Session Output to any third party
8. Intellectual Property
All website content — text, structure, design, and naming systems — is the intellectual property of Cairnpost and may not be reproduced without written permission.
Session Outputs produced by Cairnpost are delivered to and owned by the client. The naming and filing conventions used by Cairnpost are made available to clients for their own ongoing use within the family.
9. Disclaimers
Cairnpost provides clerical coordination services only. Nothing in any Session Output, written communication, or verbal exchange during a session constitutes legal, financial, estate or tax advice. Clients are responsible for engaging the appropriate registered professionals for any matters requiring professional guidance.
Session Outputs are records of information provided by the client and the documents made available during the session. Cairnpost does not verify the authenticity, completeness or legal effect of any document handled.
10. Limitation of Liability
To the maximum extent permitted by Malaysian law, Cairnpost's liability for any claim arising from a service engagement is limited to the fee paid for that engagement.
Cairnpost is not liable for: loss arising from decisions made on the basis of a Session Output; delays in third-party professional processes; or any indirect, consequential or incidental loss of any kind.
11. Confidentiality
Cairnpost treats all information encountered during a coordination engagement as confidential. We do not disclose engagement details to third parties except as required by Malaysian law or with the client's written consent. Working notes are destroyed on the day a Session Output is delivered.
12. Termination
Either party may terminate an engagement by written notice. On termination:
- Cairnpost will deliver any partial output completed to date
- Fees for work completed are non-refundable; fees for work not yet begun are refunded
- Working notes and document copies held by Cairnpost are destroyed within 5 business days
13. Dispute Resolution
These Terms & Conditions are governed by the laws of Malaysia. Disputes arising from any engagement will first be addressed through direct negotiation between the parties. If unresolved within 30 days, disputes will be referred to mediation in Selangor before any court proceedings are initiated.
The courts of Malaysia shall have exclusive jurisdiction over any matter not resolved through mediation.
14. General Provisions
- Entire Agreement: The written scope agreement and these Terms form the complete agreement between the parties for each engagement.
- Severability: If any provision is found unenforceable, the remainder continues in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
- Assignment: Clients may not assign their rights under a scope agreement without Cairnpost's written consent.
15. Changes to These Terms
We may revise these Terms & Conditions from time to time. Changes are posted on this page with an updated "Last Updated" date. Changes do not affect scope agreements already in force at the date of the change.
